AN ORDINANCE OF THE TOWN OF ESTO, FLORIDA, RESCINDING ORDINANCE NO. 2020-01 WHICH DESIGNATED THE ESTO TOWN COUNCIL AS THE LOCAL PLANNING AGENCY; RETURNING LOCAL PLANNING AGENCY RESPONSIBILITIES TO HOLMES COUNTY, FLORIDA; CONFIRMING CONTINUED ADOPTION OF THE HOLMES COUNTY COMPREHENSIVE PLAN; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE.

WHEREAS, the Town of Esto, Florida, is a home-rule municipality organized and existing under the laws of the State of Florida; and

WHEREAS, the Town of Esto has adopted the Holmes County Comprehensive Plan and Future Land Use Map as the governing comprehensive plan for land use and development within the Town limits; and

WHEREAS, on December 8, 2020, the Town Council adopted Ordinance No. 2020-01 designating the Esto Town Council as the Local Planning Agency pursuant to section 163.3174, Florida Statutes; and

WHEREAS, subsequent review and discussions with Holmes County and the Town Attorney have indicated that returning Local Planning Agency responsibilities to Holmes County would provide administrative efficiency, consistency with countywide planning efforts, and appropriate professional support; and

WHEREAS, section 163.3174, Florida Statutes, allows a municipality to rely upon a county Local Planning Agency for planning and comprehensive plan functions; and

WHEREAS, The Town Council finds that rescinding Ordinance No. 2020-01 and returning Local Planning Agency responsibilities to Holmes County is in the best interest of the Town of Esto.

NOW, THEREFORE, BE IT ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF ESTO, FLORIDA:

SECTION 1. RESCISSION.

Ordinance No. 2020-01, entitled “An Ordinance of the Town of Esto, Florida, Designating the Esto Town Council as the Local Planning Authority,” is hereby rescinded in its entirety.

SECTION 2. LOCAL PLANNING AGENCY DESIGNATION.

The Town of Esto hereby designates Holmes County, Florida, acting through its Local Planning Agency, to perform Local Planning Agency functions for the Town as provided in section 163.3174, Florida Statutes.

SECTION 3. COMPREHENSIVE PLAN.

Nothing in this ordinance shall be construed to repeal or amend the Town’s adoption of the Holmes County Comprehensive Plan and Future Land Use Map, which shall remain the governing comprehensive plan for the Town of Esto unless and until amended in accordance with Florida law.

SECTION 4: CONFLICTS.

All ordinances or parts of ordinances in conflict with this ordinance are hereby repealed to the extent of such conflict.

SECTION 5: SEVERABILITY.

If any section, subsection, sentence, clause, or provision of this ordinance is held invalid, the remainder of the ordinance shall not be affected.

SECTION 6: EFFECTIVE DATE. This ordinance shall take effect immediately upon adoption.
